Time Is Of The Essence

Time can be critical in a criminal defense case. In misdemeanor cases, for example, the state has only 90 days to bring your case to trial: and in felony cases, only 175 days. Your case needs to be ready before that time expires if at all possible. In addition, if you are charged with DUI, you only have 10 days from the date of arrest to request a hearing or a waiver to try to retain your driving privileges.

If someone is arrested on a more serious offense and they are unable to bond out, the state has 33 days to bring formal charges against you, otherwise you could be released on your own recognizance, which means without having to post any monetary bond; but this does not happen automatically. You must file a motion, and it is best to have a lawyer file this as we know the process and will do all we can to get our client released from jail. So if your loved one has been sitting in jail close to 33 days and formal charges have not been filed, you need an attorney immediately.
